IBINASURA ng korte ang kasong slight physical injuries na isinampa ng complainant na si Dennis Ibay, Jr. laban sa aktor na si Tony Labrusca.
Base sa June 12, 2021 resolution ni Makati Senior Assistant City Prosecutor Edmund Seña, napawalang-sala si Tony “on technical grounds.”
“This resolves the complaint for slight physical injuries filed by Dennis F. Ibay Jr. against Anthony Angel Jones Labrusca Jr., a.k.a. ‘Tony Labrusca.’
“Record shows that the incident subject matter of the case happened on January 16, 2021.
“However, the complaint was only filed before this Office on June 04, 2021, or after more than two months from the time of the incident.
“Considering that the complaint for slight physical injuries against respondent was only filed on June 04, 2021, or after more than two months from the date of its alleged commission, the crime is already extinguished by reason of prescription.
“Wherefore, premises considered, it is respectfully recommended that the complaint for slight physical injuries against Anthony Angel Jones Labrusca, Jr., a.k.a. ‘Tony Labrusca’ be dismissed on the ground of prescription,” laman ng resolution.
Natanggap na rin ng legal counsel ni Tony na si Atty. Joji Alonso ang kopya ng resolusyon mula sa Makati City Prosecutor’s Office na nag-aabswelto sa aktor.
“While the decision of the Honorable Office was based on technical grounds, we remain steadfast that our client is innocent from the aforesaid charge,” sabi ni Atty. Alonso.
Wala namang inilalabas na resolusyon ang Makati Prosecutor’s Office tungkol sa two counts of aggravated acts of lasciviousness case na isinampa naman ng babaeng kasama ni Ibay.
