Kahit ‘di direktang inabutan ng kickback
JPE, sabit pa rin sa PDAF scam – Miriam

IGINIIT NI Sen. Miriam Defensor-Santiago na hindi pa rin lusot si Senate Minority Leader Juan Ponce-Enrile sa pork barrel fund scam kahit pa inihayag ni Ruby Tuason na hindi niya ito direktang binigyan ng kickback mula kay Janet Lim-Napoles.

Maaalala na sa affidavit at pagharap ni Tuason sa pagdinig ng Senado, sinabi nitong iniaabot niya ang kickback ni JPE sa dati nitong chief-of-staff na si Atty. Gigi Reyes.

Kapag nagkikita aniya sila ni Reyes sa isang coffee shop para mag-abot ng pera mula kay Napoles, minsan ay dumarating ang mambabatas para sunduin ang chief-of-staff nito.

Gayunman, hindi aniya nila napag-usapan kailanman ang transaksyon sa itinuturing na reyna ng pork barrel scam na si Napoles.

Dahil dito, kumbinsido rin ang senadora, isang dating regional trial court judge, na pinagtatakpan ni Tuason si Enrile.

“It is now obvious that Tuason was covering up for Enrile, so that the entire criminal liability for plunder could be shifted to Reyes alone. That is devious of Tuason, and heartless of Enrile. He is ready to sacrifice Reyes to save himself,” pahayag pa ng mambabatas.

Gayunman, mismong sa interpellation ni Santiago kay Tuason, ipinaliwanag na nito na kahit hindi man direktang iniabot ang pera kay Enrile, ang katahimikan nito ay maituturing nang “consent.”

“Even assuming for the sake of argument that Enrile was just sitting or drinking coffee or smiling fatuitously, his mere presence is sufficient to convince the court to a moral certainty that he was the mastermind pulling the strings of Reyes, so that they could profit from the illicit scam,” ayon pa kay Santiago.

Aniya, sapat na naroon si Enrile nang mag-abutan ng kickback sina Tuason at Reyes para madiin ito sa ilalim ng prinsipyo ng conspiracy.

“A conspiracy exists when two or more persons come to an agreement concerning the commission of a felony and decide to commit it,” dagdag pa ng mambabatas.
