MAGANDANG ARAW po sa inyo. Isa po ako sa mga masugid na mambabasa ng inyong kolum araw-araw at masasabi ko pong marami akong natututunan kahit na hindi ako ang taong nagpapadala ng katanungan sa inyo. Ang tanong ko po ay tungkol sa inheritance tax.

Paano po ba nalalaman kung magkano ang inheritance tax na babayaran? Paano po kung hindi ito nabayaran? Maraming salamat po. More power.

BAGO NAMIN sagutin ang iyong katanungan mainam na ating ipaliwanag kung ano ang inheritance tax na ngayon ay tinatawag ng estate tax sa ilalim ng ating National Internal Revenue Code (NIRC). Ang estate tax ay ang ipinapataw na buwis sa karapatan ng isang yumao na ilipat ang kanyang ari-arian sa kanyang mga tagapagmana sa oras ng kanyang kamatayan. Ito ay nakabase sa batas na umiiral sa oras ng kanyang pagpanaw at hindi kung kailan ililipat ang posisyon ng mga ari-arian sa mga tagapagmana.

Nakasaad sa Section 84 ng NIRC ang halaga ng estate tax na dapat bayaran:

“SEC. 84. Rates of Estate Tax. – There shall be levied, assessed, collected and paid upon the transfer of the net estate as determined in accordance with Sections 85 and 86 of every decedent, whether resident or nonresident of the Philippines, a tax based on the value of such net estate, as computed in accordance with the following schedule:

Kaugnay nito, dapat makuha muna ang halaga ng gross estate o kabuuang ari-arian ng yumao sa oras ng kanyang pagpanaw kasama na rito ang kanyang mga personal na pag-aari, mga lupa saan man matatagpuan ang mga ito alinsunod sa nakasaad sa Section 85 ng NIRC upang makuha ang net estate pagkatapos na tanggalin sa gross estate ang lahat ng mga pwedeng ibawas dito tulad ng mga pagkakautang ng taong namatay, buwis na dapat bayaran ng namatay at iba pang nakasaad sa Section 86 ng NIRC. Ang net estate ang siyang pagbabasehan kung magkano ang babayarang estate tax.

Ang nasabing estate tax ay dapat bayaran bago ipamahagi ang parte ng mga tagapagmana sa ari-arian ng yumao na alinsunod sa Section 91(C) at Section 94 ng NIRC na nagsasaad na:

“SEC. 91. Payment of Tax. –

(C) Liability for Payment – The estate tax imposed by Section 84 shall be paid by the executor or administrator before delivery to any beneficiary of his distributive share of the estate. Such beneficiary shall to the extent of his distributive share of the estate, be subsidiarily liable for the payment of such portion of the estate tax as his distributive share bears to the value of the total net estate.

For the purpose of this Chapter, the term ‘executor’ or ‘administrator’ means the executor or administrator of the decedent, or if there is no executor or administrator appointed, qualified, and acting within the Philippines, then any person in actual or constructive possession of any property of the decedent.”

“SEC. 94. Payment Before Delivery by Executor or Administrator. – No judge shall authorize the executor or judicial administrator to deliver a distributive share to any party interested in the estate unless a certification from the Commissioner that the estate tax has been paid is shown.”

Ibig sabihin nito ay kung hindi mababayaran ang estate tax, walang ari-arian ng yumao ang maaaring ilipat o ipamahagi sa kanyang tagapagmana.
