Bagong ITR form ng BIR, labag sa batas

NANINIWALA SI Valenzuela Rep. Magtanggol Guinigundo na paglabag sa bang secrecy law at tax code ang inilabas na Revenue Regulations 2-2014, ang bagong income tax return (ITR) form ng Bureau of Internal revenue (BIR).

Inihayag ni Guinigundo na sa bagong ITR form, dapat ideklara ng isang tax payer ang interes ng kanyang mga bank deposit at iba pang income na isa aniyang paglabag sa batas, taliwas sa dating form kung saan optional lang ito.

Sa bagong ITR form din aniya ay pinapayagan ang BIR Commissioner na buksan ang bank deposits ng isang tax payer na isa na naman umanong paglabag sa batas.

“It violates the tax code itself because when you declare the interest from bank deposits one can easily extrapolate how much is the principal in your bank account,” sabi ni Guinigundo.

Iginiit pa ni BIR Commissioner Kim Henates na wala namang nakalagay na mandatory sa bago nilang form.

Wala din aniyang mali kung optional o mandatory dahil hindi naman hinihingi kung saang bangko nagdedeposito ang isang taxpayer o kung ano ang kanilang bank account number.

“I haven’t change anything about our form,” depensa ni Henares. “All the things that we are requesting have already been there in the last year’s form or in the form prior so if there’s no problem when it was there last year, and there was no problem when it was there in the previous year, what’s the problem?”
