Ayaw bigyan ng certificate of employment

Dear Atty. Acosta,

AKO PO AY naka-five years na nagtrabaho sa isang agency bilang isang motorized messenger. Ang pangalan po ng agency na pinasukan ko ay FCR Shuttle and Allied Services Corp. Nag-resign ako noong December 31, 2008. Humihingi ako ng employment certification pero ayaw akong bigyan ng may-ari ng agency. Ang gusto niyang ibigay sa akin kapag nag-apply ako sa ibang agency ay recommendation letter lang. P’wede po ba iyon na ayaw niyang magbigay ng employment certification?

Dear Arnulfo,

SA NGAYON, MAYROONG batas na nagsasabing dapat magbigay ng “Certificate of Employment” ang isang “employer” sa dati nitong empleyado o manggagawa. Ito ay napapaloob sa “Section 6, Rule XXIII, Book V, Rules Implementing the Labor Code of the Philippines” na nagsasaad ng mga sumusunod:

“SECTION 6. Certification of employment. — A dismissed worker shall be entitled to receive, or request, a certificate from the employer specifying the dates of his engagement and termination of his employment and the type or types of work on which he is employed.”

Subalit ang naturang batas ay kadalasang hindi pinapansin ng mga “employer” sapagkat wala itong probisyon para maparusahan ang mga hindi susunod dito. Ganu’n din, sinasamantala ng ibang “employer” ang ganitong sitwasyon para gipitin o gantihan ang kanilang dating empleyado o kaya naman ay para hindi na magreklamo pa ito at pumayag na sa mga kagustuhan ng dati nitong “employer”.

May nakabinbing panukalang batas (Senate Bill No. 1061) sa Senado na naglalayong parusahan ang hindi pagbibigay ng “Certificate of Employment” ng isang “employer”. Sa ganitong paraan, hindi na magagawa ng huli ang hindi magbigay ng nasabing sertipikasyon lalo na kung ito ay mayroon nang karampatang kaparusahan.

Ganu’n pa man, sa kasalukuyan, ang tanging magagawa mo para mapagkalooban ka ng “certification of employment” ay ang makiusap sa iyong dating “employer”. Kung hindi pa rin ito tutugunan, maaari kang magsampa ng reklamo sa Department of Labor and Employment (DOLE) para piliting magbigay ang naturang “employer” ng nabanggit na sertipikasyon.

    Magandang hapon po. May tanong lng po sana ako. last dec kinausap ako ng employer ko na kailangan magbawas ng tao dahil nagkakaproblema ang company and meron naman daw akong makukuhang separation pay. ask ko lng po kung gaano po ba katagal ang proseso bago maibigay ang sepration pay tsaka po nag rerequest ako ng certificate if employment dahil isa sa mga requirements yun sa bago kong papasukan na trabaho pero ang sabi saken eh kailanga ko pa daw mag file ng resignation letter bago ako mabigyan ng COE, ang tanong ko po is kung kailangan ko pa po ba tlgang mag file ng resignation letter para makakuha ng COE kahit na sila naman ang nagtanggal saken?     Tanung ko lng po kasi kanina nag punta kmi s dati naming agency .. Kukuha kami ng coe kaso hindi raw sila ng iissue ng coe sa mga seasonal lng kc seasonal lng po kmi 3months po kami ng trabaho bilang production .. Tama po ba ginawa nila na hindi kami bigyan ng coe kasi seasonal lng kami???

    Ako po si Rico ACEDILLA.
    Nagwork po ako sa Agency namen 1year at 5 months na po ako doon..Wala na po kase akong balak magrenew.kaya po tinapos ko nalang po yung contrata ko.at nahihiya din po ako bumalik sa agency dahil more than 1 month ma po ako di nag aapdates sa kanila..ask kolang po kung pwede ko ako makakuha ng COE.

    3 1/2 yrs n po ako employed s agency ko yearly nagbabayad po kmi mg 2000 pra s s renewal ng contract namin, simula po nung na hore ako wala po ako naging copy ng contract namin hanggang ngaun po wala kmi nkikita contract wala din po kami pay slip and resibo po s mga binabayaran namin s kanila,,ngaun po nag request po ako ng COE gagamitin ko po para s visa application ko kasi mag totour po kami ng amo ko for 1 week,, may bayad po 500 ung coe and ang tagal po kahit po may request letter at guarantee letter n ako from may amo yun po kc yung hinanap nila sakin pra dw issuehan nila ako ng coe..ano po pede ko gawin para bigyan nila ako agad ng coe..thank u and best regards..

    2 days absent ako dahil nagkasakit ako. Tapos sabi saken pagpasok iteterminate daw ako tapos hindi bibigyan ng employment certificate. Pwede po ba yun? Wala po bang coe pag terminate?

    I am working as a librarian in a private school and has a 1 yr probationary contract. I was asking for a copy of the contract I signed but the HR was una le to give me one. I am resigning from that school and has submitted my resignation,but my employer does not want to accept it but I have already rendered for more than 30 days and needs to start at my new job. They are refusing to release my clearance and my COE and are threatening to sue me if I did not finish my contract.The HR told me that my contract states that they will accept my resignation if I am able to finish the semester but I am unable to do that. They have already withheld my salary and wants me to bargain to my new employer to allow me to still continue working for them atleast twice a week until march because that will only be the time my replacement is available. I am unable to comply with their demands.I just want to know if there is a law prohibiting a probationary employee to quit from her job and that she needs to finish the contract? Or if you can advice me to do something for all my documents to be released.

  9. Hi Attorney,
    I was employed in a recruitment firm for 4 days only. The owner of the company fokd us that if we want to leave just him know. I sent an email that served as Resignation but I dont have copy of him and his telling me that I didn’t. He also acknowledge d my text however I don’t have any proof of text and email. I am requesting for the COE however as per the owner I am not entitled for that even though as per labor code employee who reached day 1 is entitle for coe with or without contract. Please help me with this.

    Ako po nagtrabaho sa isang private company sa security aviation ,nakadalwang contract po ako sa kanila sa madaling salita naka 1 yrs mahigit na po ako at terminated po nila ang contract ko march 11 ,2016 to march 23 ,2017 po ,ngfile po ako ng kaso for illegal dismissal humihingi po ako ng advice sa pao na humahawak ng kaso ko,pero sabi niya sa akin ay hindi mapipilit ang employer na magbigay nito at wala daw kaso ang Hindi pagbbgay ng coe Atty.ano po ang totoo?     I was already given a COE way back on July of 2013. Kaya lang po nag aplay ako as immigrant sa Canada and I was required to send the original COE. As of now kasi paalis na po ako I am requesting for another copy of COE(original) sa company ko and I explained my situation and I am being refused. Am I entitled po ba for another copy of COE? Whats are the next steps po ang pwede kung gawin if they will keep on declining my request.

    Ang concern ko po about sa COE..paanu po ang ggawin ko kc hnd ko po natpos ang contrata ko sa saudi dhl problema po sa employer..dhl nkareport po ang employer ko sa polo kaya ako nakauwi at Malabo nmn po akong bgyan ng COE ang tanung ko po is pwd din po ba akong humingi sa agency na nagpaalis sakin ng COE o may iba pa po bang paraan para ako makakuha ako nito?

  13. pwede po ba ako ma magpa issue ng cerficates of employee kahit 3 months probationary lang ako kasi ang misyo kompanya ang nag desisyon na maaga taposin ang contract ko sa kompanya.

    Ano po ba ang pwede niyo maitutulong sa akin.

  14. nagrequest po ako ng coe.
    ang sabi ipaadala nlng daw. kaso hindi dumating.. Naghintay ako ng halos 7months. Wala parin.. Tinanong ko po sa kumpanya kung pwede pa ba ako mag request ulit ng coe? Ang sabi hindi na daw pwede.. Hindi daw nila kasalanan kung hindi dumating..

    paano po ako makaakuha ng coe kelangankasi talaga.?. Anu po dapat kong gawin?

    I would just like to know if I have the right to complain or sue my employer since they don’t want to issue a COE if I would not render 30days period?

    I tendered my resignation on Feb 1, 2013 and I indicated there that the last day of my service will be on Feb 28, 2013 since I’ll be starting from my new company/job on March 1, 2013 but my superior changed the date of my resignation to March 2, 2013 because he said that February have only 28days and i really need to render 30days otherwise, I cannot get my COE.

    Also, they also reiterated that if we incurred absences during rendering period, we will be extended depending on the days we were absent and cannot file a terminal leave even if we still have remaining leaves.

    In lieu of this, I cannot start with my new job because the date of my resignation has been changed.

    Please advise and enlighten me..
